A. Session Fees
Client agrees to pay photographer a deposit of $50 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. The remaining balance ($55.93 after tax) is due at the time of the session. The $99 session fee, plus tax, covers the time and talent of the photographer and basic retouching and creative editing of images.
B. Location Costs & Fees
Your session fee covers travel within 15 minutes of Columbus, NE. Any location outside of these limits will be subject to an additional charge of $.50/mile as part of the agreement.
C. Rescheduling
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. The session fee will be applied to the rescheduled session only if booked within three months of the original appointment. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, the deposit fee of $50 is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, or other circumstances beyond their control.
D. Refunds and Reshoots
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, or hair related issues, or by not following the recommendations of the photographer. The $50 retainer is not refundable. Print fees are not refundable once proof has been approved and prints ordered.
E. Archive of Session Images
Non-ordered images will be held for an additional 60 days after your session date. All ordered images will be archived for your safe keeping. After 60 days, non-ordered images will be discarded, except as needed for promotional purposes.
F. Payment and Pricing
Due to the personalized nature of this business, all orders are non-refundable once full or partial payment is received. Images will not be processed and/or prints will not be ordered until payment is received. Prices are subject to change without notice.
G. Damage
Within 30 days, the client will receive access to the proofs for ordering processes. Client is aware that color or dyes in photography may fade or discolor over time due to inherent qualities of dyes, and the client releases Creative Images LLC from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. Creative Images LLC is not responsible for damages caused to prints or products after delivery to client. Client assumes all responsibility for the safety of all portraits upon receipt.
H. Model Release
I hereby give to Creative Images LLC the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

To copyright the same in the photographer’s name or any other name that he/she may select;

To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
I. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Due to processing and handling procedures beyond our control, client understands that no particular pose or poses can be guaranteed. Creative Images LLC takes the utmost care with respect to exposure, storage and processing of the photographs/images, but cannot and does not guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Creative Images LLC's control. In the event of a loss of digital images, Client(s) agree that Creative Images LLC or the photographer'(s) full and complete responsiblity and liability is limited to the return of all payments received for the event. Client(s) further agree that the limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the estimated percentage of the total number of original images.
J. Copyright & Penalty
Creative Images LLC retains all copyrights to all images created during client’s session. A print release may be purchased with digital files to print portraits for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is ILLEGAL to copy, scan, download, print, share, alter, or otherwise steal any image created by Creative Images LLC during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file.
K. Session Requests and Information
* No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session. The photographer will not continue if there are other cameras or video taping during the session.
* A few days before your session, we will confirm your appointment and conduct a pre-consultation. At that time, you may let us know if you are bringing any additional items to your session and what colors you have decided to wear in the studio.
* Your session starts at the agreed upon time. It is strongly encouraged that you arrive 10-15 minutes prior to the start of session. This allows for any last-minute refreshing, changing, and relaxing before session begins.
* Please be prepared to schedule a 1 hour ordering session at our studio 2-3 weeks after your session. You will be placing your order at this time so it is very important that all decision makers are present. We kindly suggest you arrange for a babysitter for small children.
